Terms of use and license agreement
Last updated: 2026-10-25
These terms apply between you and Maximilian Brenner (Bayplan, see the imprint), “we”, when you use the Bayplan desktop app, the web demo, or an account on bayplan.dev.
1. Buying a license
Licenses are sold by Creem (Armitage Labs OÜ, Estonia), our merchant of record. Your purchase contract, including payment and invoices, is with Creem under its buyer terms. Creem decides refunds based on section 4 of these terms. These terms also govern how you may use Bayplan itself.
2. What a license allows
A license is a one-time purchase that lets one person use Bayplan, for private or commercial purposes, on as many computers as their plan includes. You can move a license to another computer by removing the old one on your account page. A license can’t be shared between people; for a team, get in touch.
Your license includes the updates described when you bought it. You may keep using the versions your license covers for as long as you like.
3. Free trial
Each person and computer can try Bayplan once, free of charge, for the trial period shown on our website. The trial ends automatically; nothing is charged.
4. Refunds
Please use the free trial to check that Bayplan works for you before you buy. Your license key is delivered immediately after payment, so purchases are final and we don’t offer refunds.
If you buy as a consumer in the EU, you agree at checkout that delivery starts immediately and acknowledge that you lose your right of withdrawal once the license key has been delivered.
Your statutory rights if Bayplan is defective are not affected. If your license key doesn’t work or Bayplan doesn’t work as described, write to support@bayplan.dev and we’ll fix it or make it right.
5. License checks
Bayplan checks your license online from time to time (see the privacy policy). If it can’t connect for a longer period, it may stop working until it can check again.
6. What you may not do
You may not share, sell or publish your license key; get around the license check or the activation limit; or reverse engineer, decompile or modify the app, except where the law expressly allows it (for example §§ 69d and 69e of the German Copyright Act).
Bayplan and all rights in it remain ours. You get the right to use it as described here, not ownership.
7. Your AWS accounts
Bayplan works with your AWS accounts using the credentials and permissions you set up, and can make changes to them after you confirm. You are responsible for the permissions you grant, the actions you confirm and the AWS costs your usage causes. Cost estimates in the app are approximations, not a bill.
Bayplan is an independent product and is not affiliated with or endorsed by Amazon Web Services.
8. Warranty
If you are a consumer, your statutory rights regarding defects apply. Otherwise, Bayplan is provided as it is at the time of purchase, and we don’t warrant that it is free of errors or works without interruption.
9. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee or fraudulently concealed a defect.
For slight negligence, we are liable only if we breach an obligation that is essential for the contract and that you may rely on (a cardinal obligation), and then only for the damage that was foreseeable and typical for this kind of contract when the license was bought. Otherwise, we are not liable for slight negligence.
For anything we offer free of charge, such as the free trial, the web demo and the free tools on our website, we are liable only for intent and gross negligence, apart from the cases of unlimited liability above. Results of the free tools are estimates.
Changes in your AWS accounts are made only after you confirm them, with the permissions you grant. We recommend read-only permissions where you don’t need to make changes, and a backup or restore plan for important resources. If data is lost, we are liable only for the effort it would have taken to restore it from regular, appropriate backups. Where damage results from missing safeguards, this counts against your claim.
We are not liable for outages or changes of AWS or other third-party services, or for AWS costs, except as set out above.
If you are a business, claims under this section for slight negligence expire one year after the claim arose and you learned of it. This does not apply to the cases of unlimited liability above.
These limits also apply to the personal liability of anyone working for us.
10. Your account
You can delete your account at any time on your account page. We may suspend an account or license that is used against these terms, in particular a shared or published key.
11. Changes to these terms
We may change these terms for future versions and new purchases. Changes don’t take away rights from a license you already bought.
12. Law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live still apply. If you are a merchant, the courts at our place of business have jurisdiction.
If any part of these terms is invalid, the rest remains in effect.
